Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of Mailtidy (the “Service”), operated by Positor Group LLC (“Positor Group,” “we,” “us,” or “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Mailtidy lets you connect one or more third-party email mailboxes and read them together in a single, unified inbox. The Service accesses your mailboxes on your behalf using credentials you provide. We may add, change, or remove features at any time.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements.

3. Your account

You are responsible for the information you provide and for all activity that occurs under your account. Keep your login credentials confidential and notify us promptly of any unauthorized use. You are responsible for maintaining the security of the email accounts you connect.

4. Connected mailboxes

When you connect a mailbox, you authorize Mailtidy to access, retrieve, and display its contents on your behalf. You represent that you have the right to grant this access and that doing so does not violate the terms of your email provider or any law. Your use of a connected mailbox remains subject to that provider’s own terms.

5. Acceptable use

You agree not to:

• use the Service in violation of any applicable law or regulation;
• access accounts or data you are not authorized to access;
• interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure;
• reverse engineer, scrape, or resell the Service except as permitted by law; or
• use the Service to send unsolicited, fraudulent, or unlawful communications.

6. Intellectual property

The Service, including its software, design, and content (excluding your email data), is owned by Positor Group and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. Your email data remains yours.

7. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any email will be delivered, retrieved, or displayed without delay or error.

8. Limitation of liability

To the fullest extent permitted by law, Positor Group will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars (US $100).

9. Indemnification

You agree to indemnify and hold harmless Positor Group and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service or your violation of these Terms.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in New York, New York for any dispute arising out of or relating to these Terms or the Service.
